 How about Work permits or visas for foreign workers?

The work permit is valid for one year and may be extended as long as the validity of extension does not exceed the fixed period in the residency permit of the person in question.



Work permit and employment card for foreigner requires owners or directors of enterprises who need to hire foreign workers to work in Cambodia to apply for their work permits and employment cards.

Note: Key Outcomes:

- No Foreigner can work unless he possess a work permit and employment card issued by the Ministry of Labor. The following Conditions must be met:
(a) Employers must beforehand have a legal work permit to work in Cambodia
(b) Foreigners must have legally entered Cambodia
(c) Foreigners must possess a valid passport and a valid residency permit
(d) Foreigners must be fit for their job and have no contagious diseases.
- The work permit is valid for one year and may be extended in line with the residency permit
- The Ministry of Interior, in collaboration with the Ministry of Social Actions, Labor, and Veteran Affairs, shall have the power to conduct checks and maintain controls on the labor/working cards of foreign workers in every factory, enterprise, company, and establishment.
- The Ministry of Interior shall have jurisdiction over the imposition and collection of all fines
- Besides the principal punishment provided by the law, this is a sub-punishment of expulsion
- The Ministry of Interior shall have the power to expel every alien
(a) That is participating in an activity or behavior dangerous to the national security of Cambodia
(b) Is a dissident to national security
(c) Is working without a labor or working card
- Every Employer must make a declaration to the Ministry of Labor and Vocational Training each time when hiring or dismissing a worker. This declaration must be made in writing within 15 days at the latest after the date of hiring or dismissal
- Each enterprise is required to justify, during the entirety of its existence, that each of the three categories of personnel specified below include the minimum percentage of workers of Cambodian nationals as already provided:
(a) Office personnel
(b) Specialized personnel
(c) Non-specialized personnel
- Any person who hires or keeps in his service a foreigner who does not possess the employment card authorizing him to carry out a paid job in Cambodia, is liable to a fine of 60 to 90 days of the base daily wage or imprisonment of 6 days to 1 month.
Verbally:
- Tax is retroactive from the first Business Visa (E Visa), at USD 100 per year. If someone is offering lower (USD 80), it is not legitimate
- Shareholders who do not earn a salary, but work, must get work permits.
- Retirees do not need work permits
- Enforcement has been lax for 13 years and this is over. Enforcement will be stringent.
